Finally Approved: We are back on track!

Today was a good day when it comes to the building of the house. Finally. we got approval on the plan revisions and a release on the job copies at the building department. This means that we can resume construction! Today, Chelsea and I went to the building department to pick up the revised plan stamped by the county and paid the $75 red tag we received for violating their terms. Boo! Now I have to take the plan to the permit box on Sunday afternoon for our inspection on Monday. Hopefully the inspector will not find any problems and we can be on track for a Tuesday slab pour.

No review was made due to insufficient application. C NR-LAL: Received application sufficiency checklist on 02/05/09, and it was reviewed with the material received 02/02. The application remains insufficient for the following reasons: (1) It does not appear that the home can be constructed on the subject lot, which is located in zoning district ASC-1. This district requires a 50′ rear and front yard building setback, and 15′ side yard setback, 150′ wide lot, and minimum one acre lot size. The applicant is asked to provide written documentation that our graphics section has approved the home to be built on the subject lot as shown, before the NR-LAL SFD permit can be approved. Meanwhile, we will review the plan as received on 02/02/09. (2) Need plan modified to state the type of home construction (slab on grade, stemwall, stilted, etc) in accordance with the endorsed application sufficiency checklist. (3) Site inspection reveals that the 24″ dbh oak tree’s dripline extends about 38′ from the tree to the north, and that the tree’s limbs grow low. It was found to be in good condition despite trimming for utility wires. Placement of the home as shown would require almost half of the remaining branches to be trimmed about half way back to the tree trunk. This will be considered an impact that will cause the tree to decline, and with the driveway to be constructed so close, the tree should be “X”ed out for removal. 50% replacement will be required (12″ dbh). It appears there is room on the lot to plant the trees, so this will be the required replacement option and will be a permit condition when the application is approved for issuance. Note that this list of concerns includes concerns that would be identified after the application has been determined sufficient, but replying to these will speed review once the application is found to be sufficient. C NR-LAL: Met with builder Brian Cirillo and lot owner Chelsea Devito on 04/01/09. They stated the variance is pending, and that they want to trim but not remove the 24″ dbh oak, and that the site’s improvements will not change from what was shown on the previously-received plans. I stated that the tree can be preserved if desired, but we will not give them credit for saving it due to the proposed impacts from trimming and driveway construction. Ms. Devito agreed to plant 12″ dbh of shade trees on the lot, outside of the dripline of preserved trees (on and off the lot), before CO, as replacement. She understands that the 0.21 acre lot will require two lot trees (6′ tall, Florida Grade #1), and that any of the lot trees planted larger than 1″ dbh will be credited towards the 12″ dbh replacement. The comments from 02/05/09 have been modified as follows; the application remains insufficient for the following reasons: (1) It does not appear that the home can be constructed on the subject lot, which is located in zoning district ASC-1. On 05/18/09 we received revised plot plans and a copy of variance VAR 09-0430 KO, approved on May 15, 2009, permitting the (two) front yard setbacks to be 25′ and side yard setbacks to be 7.5′ as is shown on the approved plan for the legally non-conforming lot.
